Terms of service

1. Who we are

The Soft Place is run by Kola Bilewu, a sole trader in England, of 45 Deckham Terrace, Gateshead, NE8 3UY, United Kingdom. You can reach us at kola@thesoftplace.co.uk.

2. What you are buying

A website built from one of our templates: the layout you choose, adapted with your business name, words, images and contact details, connected to your domain, with hosting and SSL included while your subscription is active.

• £499 a year — template adaptation, up to five pages, domain connection, hosting and SSL, one content edit a month.
• £699 a year — the above plus copywriting, up to eight pages, two revision rounds and two hours of edits a month.

3. What is not included

Paid stock photography, logo design, email hosting, custom software, booking systems, e-commerce, MLS or other data feeds, and copy translation.

4. How it works

You pick a layout and send your details. We build a first version within five working days and send you a preview link. You send changes; we make them and publish. Two rounds of changes are included on the £699 plan, one on the £499 plan. Further rounds are charged hourly, agreed with you first.

5. Price and payment

The price is annual and taken in advance. It renews each year on the same date unless you cancel before it. We will remind you at least seven days before a renewal. Prices may change at renewal; we will tell you at least thirty days before.

6. Changing your mind

You may cancel for a full refund at any time before we publish your website, including after seeing the first preview. Within the first fourteen days that is your statutory right as a consumer; if we have already started work at your request, we may charge proportionately for work done, except where you cancel because the preview is not what you expected, in which case the refund is full. Once the site is published the year's fee is not refundable, but you may cancel the renewal at any time. The full policy is on our refund page and forms part of these terms.

7. Cancelling and what happens after

If you do not renew, we take the site offline at the end of your paid year and keep a copy for ninety days. Ask us within that period and we will export it to you.

8. Your content

You keep ownership of your words, photographs and logo, and you confirm you have the right to use them. You are responsible for anything the site publishes being accurate and lawful. We may refuse content that is unlawful, misleading or that we cannot verify.

9. Our work

We keep ownership of the template, the code and the design system. You own the finished site's content and get a licence to use the design for as long as you subscribe. If you leave, the design does not transfer.

10. Availability

We aim to keep sites online all the time but we do not guarantee it. If a site is down for more than 48 hours in a month through our fault, we will add a month to your subscription.

11. Liability

We are responsible for the service we provide. We are not responsible for lost profits, lost business or indirect losses. Our total liability in any year is limited to what you have paid us in that year. Nothing here limits liability for death, personal injury or fraud.

12. Complaints

Email kola@thesoftplace.co.uk. We will reply within five working days and aim to resolve it within twenty-eight.

13. Law

These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction.

14. Changes

We may update these terms; the version in force is the one on this page when you order or renew.
